Terms of Service

1. Definitions

• "Software" — the Elysian client application, radar overlay, web radar, and all associated tools and modules made available under a license.
• "License" — the limited right to use the Software as described in Section 3.
• "Supported Games" — third-party video games for which Elysian provides features, including but not limited to Rust, Counter-Strike 2, Escape from Tarkov, and ARC Raiders.
• "Game Publishers" — the respective developers and publishers of Supported Games, including but not limited to Facepunch Studios, Valve Corporation, Battlestate Games, and Embark Studios.
• "Anti-Cheat Systems" — any third-party anti-cheat or integrity software associated with Supported Games, including but not limited to Easy Anti-Cheat (EAC), BattlEye, Valve Anti-Cheat (VAC), and any proprietary systems deployed by Game Publishers.
• "External Interaction" — the method by which the Software operates: reading data from system memory via external hardware interfaces without injecting code into, modifying, or patching any game process or file.
• "Telemetry Data" — system and behavioural data automatically collected by the Software as described in Section 12, including but not limited to hardware identifiers, system configuration, and session information.

2. Eligibility

You must be at least 18 years of age to use our services. By agreeing to these Terms you represent that you meet this requirement and have the legal capacity to enter into a binding agreement. You are solely responsible for ensuring your use of the Software complies with all laws applicable in your jurisdiction.

3. License Grant

Subject to these Terms and payment of any applicable subscription fee, Elysian grants you a revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on hardware registered to your account, solely for your personal, non-commercial use during the active license period.

This license does not convey any ownership rights in the Software. All rights not expressly granted herein are reserved by Elysian. The license may be revoked at any time in accordance with Section 13 (Termination).

4. No Warranty of Functionality

The Software's functionality is inherently dependent on the state of third-party Supported Games, their underlying engines, operating systems, and Anti-Cheat Systems — none of which are under Elysian's control. You expressly acknowledge and accept that the Software may become partially or fully non-functional at any time as a result of, without limitation:

• Game updates, patches, or hotfixes issued by Game Publishers;
• Anti-Cheat System updates, signature changes, or enforcement actions;
• Operating system updates or driver-level changes;
• Hardware or firmware updates affecting system memory access;
• Changes to game memory layouts, encryption, or obfuscation.

Elysian will make commercially reasonable efforts to restore functionality following such events, but makes no commitment to a restoration timeline. Periods of non-functionality ("Downtime") may be compensated at our sole discretion by extending active license periods. Such compensation is a courtesy and does not constitute an admission of liability or a guarantee of future compensation.

5. No Affiliation with Game Publishers or Anti-Cheat Systems

Elysian is an independent software provider and is in no way affiliated with, endorsed by, sponsored by, or in partnership with any Game Publisher or Anti-Cheat System provider, including but not limited to:

• Facepunch Studios (publisher of Rust)
• Valve Corporation (publisher of Counter-Strike 2 and operator of VAC)
• Battlestate Games (developer of Escape from Tarkov)
• Embark Studios (developer of ARC Raiders)
• Easy Anti-Cheat (EAC), operated by Epic Games
• BattlEye Innovations e.K.
• Any other current or future Anti-Cheat System provider

All product names, trademarks, and registered trademarks referenced herein belong to their respective owners. Reference to any third-party product does not imply affiliation, endorsement, or authorisation.

6. External Interaction & Non-Circumvention

The Software operates exclusively through External Interaction. It reads data from system memory via external hardware interfaces (e.g. PCIe DMA hardware). The Software does not, and is not designed to:

• Inject code, libraries, or modules into any game process;
• Modify, patch, or alter any game executable, file, or asset on disk or in memory;
• Bypass, disable, circumvent, or interfere with any Anti-Cheat System;
• Decrypt, deobfuscate, or circumvent any encryption, copy-protection, or technological protection measure employed by any game or software;
• Intercept, manipulate, or forge any network traffic between a game client and its servers.

Accordingly, the Software is not designed to — and Elysian does not intend for it to — circumvent any technological protection measure within the meaning of 17 U.S.C. § 1201 (the Digital Millennium Copyright Act) or equivalent legislation in other jurisdictions. Any use of the Software to circumvent such measures is strictly prohibited and constitutes a material breach of these Terms.

Notwithstanding the foregoing, Elysian makes no warranty that Anti-Cheat Systems or Game Publishers will interpret the Software in a manner consistent with this section. Detection and enforcement decisions by Anti-Cheat Systems are beyond Elysian's control and knowledge.

7. Risk Acknowledgment & Game Account Liability

Elysian accepts no responsibility or liability whatsoever for any action taken against your game account(s) by any Game Publisher, Anti-Cheat System, or platform operator, including but not limited to account suspension, permanent bans, loss of in-game items or progress, or any other enforcement action. You use the Software entirely at your own risk in this regard.

8. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, deobfuscate, or attempt to derive source code from the Software;
• Distribute, resell, sublicense, lease, or otherwise transfer the Software or your license to any third party;
• Share your account credentials or allow any other person to access the Software under your account;
• Publicly disclose, leak, or publish any license key, authentication token, or internal Software component;
• Use automated tools or scripts to interact with our web services, APIs, or infrastructure;
• Attempt to probe, scan, exploit, or test the vulnerability of any Elysian system;
• Use the Software in any manner intended to harass, harm, or disadvantage other users beyond normal gameplay;
• Make any false claim that the Software is affiliated with or endorsed by any Game Publisher or Anti-Cheat provider.

9. Accounts & Hardware Binding

• You are responsible for all activity that occurs under your account.
• You must provide accurate registration information and keep it current.
• Each license is bound to a single hardware identifier (HWID). Use on additional hardware requires an additional license unless otherwise stated.
• HWID resets are permitted once per calendar month. Additional resets may be requested via support at our discretion.
• Attempts to spoof, emulate, or manipulate your HWID to circumvent hardware binding constitute a material breach of these Terms.

10. Subscriptions & Payments

Access to the Software requires an active, paid license for the relevant product. Licenses are time-limited and expire at the end of the purchased period. We reserve the right to modify our pricing, license tiers, or product availability at any time. Price changes will be communicated with reasonable notice and will not affect licenses already purchased for their remaining duration.

No Refunds. All purchases are final and non-refundable, except where expressly required by applicable consumer protection law. Elysian's inability to maintain software functionality due to third-party game or anti-cheat changes (as described in Section 4) does not entitle you to a refund.

EU Right of Withdrawal. Where applicable law grants a right of withdrawal for digital content (including under EU Consumer Rights Directive 2011/83/EU, Article 16(m)), by completing your purchase and requesting immediate access to the Software you expressly acknowledge that delivery of digital content commences before the withdrawal period expires, and you thereby waive your right of withdrawal. This acknowledgement is recorded at the time of purchase. Where local law does not permit waiver of withdrawal rights, standard statutory periods apply.

11. Intellectual Property

The Software and all associated materials — including but not limited to source code, object code, architecture, design, interface, documentation, and branding — are the exclusive intellectual property of Elysian and its licensors, protected by copyright, trade secret, and other applicable law. These Terms do not transfer any ownership or intellectual property rights to you. Any unauthorised use, reproduction, or distribution of the Software or any component thereof is strictly prohibited and may give rise to civil and criminal liability.

12. Telemetry, Privacy & Data Collection

By installing and using the Software, you expressly consent to the automatic collection and transmission of Telemetry Data to Elysian's servers. This data is collected for the purposes of license enforcement, security, fraud prevention, compatibility diagnostics, and Software improvement. The following categories of data are collected:

Use & Retention. All collected data is used solely for the purposes stated above. We do not sell, rent, or share your data with third parties except where required by applicable law, or where strictly necessary to operate essential infrastructure and payment providers, who are contractually bound to process data only on our instructions. Telemetry Data is retained for the duration of your account and for a minimum period of 12 months thereafter for security audit and legal compliance purposes.

Consent. Collection of Telemetry Data is a non-negotiable operational requirement of the Software. You may not opt out of Telemetry Data collection while using the Software. If you do not consent to this collection, you must not install or use the Software and must close your account.

13. Termination

Elysian reserves the right to suspend, restrict, or permanently terminate your account and all associated licenses at any time, with or without prior notice, at our sole discretion. We are under no obligation to provide a reason for termination, though we will generally do so where practicable. Grounds for immediate termination include, without limitation:

• Any breach or suspected breach of these Terms;
• Sharing, selling, transferring, or otherwise granting access to your account or license to any third party;
• Reverse-engineering, decompiling, leaking, or publicly disclosing any component of the Software;
• Spoofing, emulating, or otherwise manipulating your HWID to circumvent hardware binding or license enforcement;
• Initiation of a chargeback, payment dispute, or fraudulent payment claim;
• Conduct that poses a security risk to Elysian's infrastructure, user base, or intellectual property;
• Use of the Software in a manner that exposes Elysian to legal risk or reputational harm;
• Any violation of applicable local, national, or international law.

Effect of Termination. Upon termination for any reason:

• Your license to use the Software is immediately and automatically revoked;
• Access to the Software, your account, and all associated data will be disabled;
• Any remaining unused license time is forfeited without compensation or refund;
• Elysian may retain your data as required for legal, security, or audit purposes in accordance with Section 12;
• Provisions of these Terms that by their nature should survive termination — including Sections 11 (Intellectual Property), 12 (Telemetry & Data), 14 (Limitation of Liability), 15 (Indemnification), and 17 (Governing Law) — shall remain in full force and effect.

Voluntary Closure. You may request closure of your account at any time by contacting support. Voluntary closure does not entitle you to any refund of unused license time and does not waive any obligation you have accrued under these Terms prior to closure.

14. Limitation of Liability

Without limiting the foregoing, Elysian expressly excludes all liability for:

• Loss of, or enforcement action against, any game account — including permanent bans, temporary suspensions, loss of in-game items, currency, progress, or rank — resulting from your use of the Software or any decision made by a Game Publisher or Anti-Cheat System;
• Any full or partial loss of Software functionality caused by game updates, patches, Anti-Cheat System updates, operating system changes, driver updates, or hardware changes;
• Any financial loss, loss of business, or loss of opportunity arising from Software Downtime or the discontinuation of any Software feature or supported game;
• Any damages resulting from unauthorised access to, or alteration of, your account or data;
• The conduct or content of any third party, including Game Publishers, Anti-Cheat System providers, or other users;
• Any reliance placed on information or representations made by Elysian regarding Software functionality, compatibility, or safety with respect to any Supported Game or Anti-Cheat System;
• Loss or corruption of Telemetry Data or other data transmitted by or to the Software.

Aggregate Cap. In all cases and notwithstanding any other provision of these Terms, Elysian's total cumulative liability to you for all claims arising out of or related to these Terms or the Software shall not exceed the lesser of: (a) the total amount paid by you to Elysian in the 30 calendar days immediately preceding the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain categories of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Indemnification

You agree to indemnify, defend, and hold harmless Elysian and its owners, officers, directors, employees, contractors, agents, licensors, and successors from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, penalties, fines, costs, and expenses — including reasonable legal and professional fees — arising out of or in connection with:

• Your access to or use of the Software, including any harm caused to third parties as a result thereof;
• Your breach or alleged breach of any provision of these Terms;
• Your violation of any applicable law, regulation, or third-party right — including the terms of service of any Game Publisher or Anti-Cheat System provider;
• Any claim by a Game Publisher, Anti-Cheat System provider, or platform operator arising from your use of the Software in connection with their products or services;
• Any misrepresentation made by you, including any false claim regarding affiliation, endorsement, or authorisation;
• Any enforcement action, legal proceeding, or regulatory inquiry triggered by or related to your use of the Software.

Publisher & Anti-Cheat Indemnification. Without limiting the foregoing, you specifically agree to indemnify and hold Elysian harmless against any claim, action, demand, or proceeding brought by any Game Publisher, Anti-Cheat System provider, or platform operator — including but not limited to claims under the Digital Millennium Copyright Act (17 U.S.C. § 1201), EU Directive 2001/29/EC on copyright, or equivalent legislation in any jurisdiction — alleging copyright infringement, circumvention of technological protection measures, or violation of any terms of service, arising out of or relating to your use of the Software in connection with any Supported Game or its associated platform.

Elysian reserves the right, at its own expense, to assume exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with Elysian's defence of such claim. You may not settle any claim that imposes any obligation, restriction, or liability on Elysian without Elysian's prior written consent.

16. Modifications to These Terms

Elysian reserves the right to modify, replace, or restate these Terms at any time and for any reason, at its sole discretion. The most current version of these Terms will always be available at /terms and will supersede all prior versions.

Where changes are material — including but not limited to changes affecting data collection practices, license scope, liability, or payment terms — we will provide notice by one or more of the following means at least 7 days before the revised Terms take effect:

• Email to the address registered to your account;
• A prominent banner or notification within the platform or client Software;
• An update to the "Last updated" date at the top of this page.

Your continued use of the Software or our services after the effective date of any modification constitutes your binding acceptance of the revised Terms. If you do not agree to the modified Terms, you must immediately cease all use of the Software and contact support to close your account. No refund of any unused license period will be issued solely on the basis of a disagreement with updated Terms.

17. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law. In the event of any dispute arising out of or relating to these Terms or the Software, the parties agree to first attempt resolution in good faith through direct communication. You agree that any claim must be brought in your individual capacity; you waive any right to participate in a class action or representative proceeding against Elysian.
